What Oben won't tell you: the legal realities
Defective EV? How to file a consumer complaint in India
A plain-language guide for owners of an Oben Rorr — or any electric vehicle — that is defective, unsafe, or stuck in a service loop. Written by an owner going through it, not by a lawyer; check details with the official portals linked below.
Your rights under the Consumer Protection Act, 2019
The Act gives every consumer the right to be protected against goods that are hazardous to life, and the right to seek redressal against unfair trade practices. A defect includes any fault or shortcoming in quality or performance; deficiency covers shortcomings in service. Where these are proved, a Consumer Commission can order the company to:
- remove the defect,
- replace the goods with new goods of similar description free of defect,
- refund the price paid,
- pay compensation for loss or injury, and costs.
A company's “current policy” that it doesn't replace or refund is not binding on the Commission.
Step 1 — Build your evidence file now
Step 2 — Complain in writing to the dealer and manufacturer
Email both. State the vehicle (chassis/VIN), the defect, the dates, and exactly what you want (repair within X days, replacement, or refund). Keep it factual. Note the ticket number.
Step 3 — National Consumer Helpline (NCH)
Call 1915, or file at consumerhelpline.gov.in or the NCH app. NCH forwards your grievance to the company for resolution. Save the docket number — it shows you tried to resolve the dispute before litigation.
Step 4 — Legal notice
If NCH doesn't resolve it, a legal notice giving a final deadline (often 15 days) is a common next step. A lawyer can send it, but you can also draft one yourself.
Step 5 — File on e-Daakhil
Consumer complaints can be filed online at edaakhil.nic.in. For claims up to ₹50 lakh, the forum is the District Consumer Disputes Redressal Commission. You can file where you live or work, not only where the company is. Upload your evidence, pay any applicable fee online, and you'll receive hearing dates.
Insurance issued without your consent?
First, write to the insurer's grievance cell with your objection and the policy number. If not resolved within the insurer's timeline, escalate through IRDAI's grievance system (Bima Bharosa) and, if needed, the Insurance Ombudsman. Keep your objection emails — the date you objected matters.
Your KYC documents used without permission?
Under the Digital Personal Data Protection Act, 2023, personal data should be used only for the purpose you consented to. Write to the company asking what your Aadhaar/PAN were used for, by whom, and on what date.
FAQ
Where do I complain about a defective electric bike in India?
Start with a written complaint to the dealer and manufacturer. If unresolved, register a grievance with the National Consumer Helpline (call 1915 or use consumerhelpline.gov.in / the NCH app). If that fails, file a consumer complaint online through e-Daakhil (edaakhil.nic.in) before the District Consumer Disputes Redressal Commission.
Can I get a replacement or refund for a defective new vehicle?
Under the Consumer Protection Act, 2019, a Consumer Commission can order removal of the defect, replacement with a similar product free of defect, refund of the price, and compensation, depending on the facts. A company's internal “no replacement” policy does not override what the Commission can order.
Is there a fee to file a consumer complaint?
For claims up to ₹5 lakh, there is no fee at the District Commission. Above that, a small slab-based fee applies. Check the current fee schedule on e-Daakhil when filing.
How long do I have to file?
Generally within two years from the date the cause of action arose.
Do I need a lawyer?
No. You can file and argue your own complaint. Many people use a lawyer for drafting, but it is not required.
